The article deals with the problems of practical application of forensic examination in construction and real estate. The result of the expert studies largely depends on the further outcome of the case. In this regard, we believe it is necessary to legislate at the Federal level additional guarantees of quality and completeness of expert research. The article gives characteristics of the FZ «On state forensic activities in the Russian Federation» which marked the professional and qualification requirements to the expert in the state judicial-expert establishments. Judicial practice on the issues of expertise in construction and real estate is given and analyzed.
