Abstract. <\/strong>For breeding, the mechanism of collecting royalties (breeding remuneration), which is possible only from certified seeds, is of paramount importance. The Civil Code of the Russian Federation provides for the protection of intellectual rights to breeding achievements. The protection of the rights of patent holders will be more complete, provided that the merchant sells seeds only of those varieties for which royalties have already been paid. The collection of royalties will, in the coming years, be one of the central issues with regard to breeding, seed production and commercial seed production. The development of new plant varieties is very important to the overall food security of the country. Intellectual property protection for new plant varieties and hybrids is aimed at increasing investment in genetic innovation. The concept of Plant breeder’s rights (PBR) is clearly spelled out in international law and harmonized by the International Convention for the Protection of New Varieties of Plants, which is constantly monitored by the International Union for the Protection of New Varieties of Plants (UPOV). The patents, and therefore the breeders’ rights, are secured by the duration of the exclusive legal right to commercially use a new plant variety or hybrid. In order to obtain this type of protection, the breeder must show that his variety is distinctive, homogeneous and stable in its basic characteristics. Any intellectual property, including in the field of breeding and seed production, shall have certain types of royalties to the breeder — patentee, for the use of his breeding achievement — «royalty». In any developed country, the procedure of such royalties is approved at the legislative level and has successfully proved itself. In our country there were no such types of royalties in the times of the USSR, all financing of breeding and seed breeding industry was at the disposal of the state management bodies. Over the past 30 years in the new history of the Russian Federation, although there have been changes, but royalties have not gained the proper level of development today, although it is worth noting
