The article deals with topical issues of research problems of application of special construction and technical knowledge in determining the suitability for living in the course of the SSTE to be established in the process of interaction between the court and experts-builders; the features of special construction and technical knowledge and the possibility of their use in identifying this category of premises. Judicial practice shows that the expert’s opinion is becoming increasingly important in resolving housing disputes. If earlier the decision on the appointment of construction and technical expertise depended on the discretion of the court and its assessment of the sufficiency of the evidence collected in the case, in recent years, the armed forces of the Russian Federation increasingly draws the attention of lower courts to the fact that the resolution of questions about the quality of housing requires the use of special knowledge.
